These Terms of Service ("Terms") govern your use of the TipShift mobile application ("the App") operated by Monaco IT Services LLC, a Delaware limited liability company ("we", "us", "our").
By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Description of Service
TipShift is a tip tracking application designed for restaurant workers in the United States. The App allows you to log tips, track earnings, generate reports, and view income summaries.
Important: TipShift is an informational tool only. The App does NOT provide tax, legal, or financial advice. Any reports, summaries, tax estimates, or IRS-related features are for personal record-keeping purposes only and should NOT be submitted directly to any government agency. Always consult a licensed tax professional for tax filing and compliance.
2. Not Tax or Legal Advice
- The App is a personal record-keeping tool, not a tax preparation service.
- IRS threshold alerts, FICA estimates, Form 4070-A templates, and employer summaries are informational aids only.
- You are solely responsible for accurately reporting your tip income to the IRS and your employer.
- We make no guarantees about the accuracy, completeness, or legal sufficiency of any data or reports generated by the App.
3. User Responsibilities
- You are responsible for the accuracy of the tip data you enter.
- You are responsible for complying with all applicable tax laws and regulations.
- You must not use the App for any unlawful purpose.
- You are responsible for maintaining the security of your device and account.
4. Subscriptions and Payments
- The App offers a free tier and a paid "Pro" subscription.
- Subscriptions are processed through Apple App Store or Google Play Store.
- Subscription management (cancellation, renewal) is handled through your Apple or Google account.
- Refunds are subject to the respective store's refund policies.
- We do not directly process any payment information.
5. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
6. Intellectual Property
The App, including its design, code, and content, is owned by Monaco IT Services LLC. You may not copy, modify, distribute, or reverse-engineer the App.
7. Disclaimer of Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, Monaco IT Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:
- Your use or inability to use the App.
- Any inaccuracies in tax estimates, reports, or calculations.
- Unauthorized access to your data.
- Any third-party services used by the App.
9. Account Termination
You may delete your account at any time through the App's Settings. We reserve the right to suspend or terminate accounts that violate these Terms.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes through the App.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
